PROFIT á PRENDRE: TREES
THIS AGREEMENT is made the day of _
BETWEEN:
SUZU MATSUYAMA (hereinafter the "Land Owner") of ,
OF THE FIRST PART
AND:
GREENLAND CONSERVATION SOCIETY (hereinafter "Greenland") of _
OF THE SECOND PART
IT IS AGREED as follows:
1. Subject to the conditions of sale set out in this agreement, the Land Owner agrees to sell, and Greenland agrees to buy, all the trees standing on the Land Owners lands situated at R.R. #1, Saanich, British Columbia, and more particularly known and described as:
[Lot X, Block Y, Plan #]
2. Greenland agrees to pay the Land Owner the amount of $ 1.00, receipt whereof is hereby acknowledged, for the trees standing on the Land Owner's lands.
3. Greenland agrees:
a. not the cut any of the trees on the Land Owner's lands without the written permission of the Land Owner;
b. to steward the trees on the Land Owner's lands by inspecting them on a regular basis, and where appropriate and where the health of the trees or some of them require it, recommend such trimming or cutting down of the trees, as Greenland considers reasonable, to the Land Owner;
4. The Land Owner will not reasonable refuse her permission to Greenland to trim or cut those trees which Greenland has recommended to be trimmed or cut down.
5. The Land Owner agrees to give Greenland, their workers, or others acting on their behalf or are authorized by them, without extra payment:
a. access to the trees on the land for the purposes of inspecting, trimming, falling, or otherwise dealing with the trees;
b. to store on the lands at a place and in a manner to be agreed upon between the Land Owner and Greenland, such equipment as Greenland may reasonable require to carry out its inspecting, trimming or falling of the trees;
6. This profit á prendre shall run with the land and all parts thereof, and in the event of subdivision, shall be binding upon all subdivided parcels.
